Bankruptcy has a bad rap – we are here to change that perception. Financial problems happen to people from all walks of life; whether from income drop/loss, divorce, medical issues, business failure, or bad financial decisions (we have all made them!) unmanageable debt may result.
Chapter 7 is referred to as “straight” or “liquidation bankruptcy”. In a liquidation, the debtor turns all of his non-exempt assets over to a trustee who then liquidates (sells) all the assets and distributes the proceeds to the debtor’s creditors.
Chapter 13 bankruptcy is sometimes referred to as a “repayment” plan because debtors pay some or all of their unsecured debts (interest free) over a 3-5 year plan. Your payment is based on what you can afford to pay (income minus expenses).

The Chapter 7 bankruptcy is known as the “liquidation” bankruptcy. Basically, the debtor relinquishes his property to the bankruptcy trustee, and receives a discharge of his debts.
In a Chapter 13 bankruptcy, the debtor is allowed to keep most or all of his property, and receive a discharge of his debts, upon the monthly payment of a sum of money to the bankruptcy trustee for a period of three to five years.
